Terms of Service
These Terms of Service apply to purchases made through the online shop Whisper Asian Fashion, operated by Edda Erbers in Austria.

2. Scope
These Terms apply to contracts concluded with consumers through whisperasianfashion.com.
Mandatory consumer rights under applicable Austrian and EU law remain unaffected.
3. Ordering and conclusion of the contract
The presentation of products in our online shop is an invitation to place an order and does not itself constitute a binding offer.
Before submitting your order, you can review and correct your selected products and the information entered during checkout.
By clicking the final button that clearly indicates an obligation to pay, you submit a binding offer to purchase the products in your order.
After placing your order, you will receive an order confirmation email.
A contract is concluded when we expressly accept your order or when the goods are dispatched. An automated confirmation that we have received your order does not itself constitute acceptance unless it expressly states otherwise.
Please keep your order and shipping confirmation emails for your records.
4. Prices and VAT
All prices are displayed in euros (EUR).
VAT is not charged under the Austrian small-business exemption pursuant to § 6 Abs. 1 Z 27 UStG.
Shipping costs are additional and are displayed before you complete your order.
5. Payment
You can use the payment methods displayed during checkout.
The payment conditions and timing applicable to the payment method you choose are shown during the checkout process.
6. Shipping and delivery
Orders are dispatched from Austria.
Current shipping destinations, shipping costs and estimated delivery times are listed in our Shipping Policy and are also shown where applicable during checkout.
Our current shipping rates are:

Austria and Germany: €3.90 standard shipping or €6.90 shipping with tracking

Other supported EU destinations: €12.00 standard shipping
Shipping charges apply regardless of the order value. We currently do not offer free shipping.
Processing normally takes 1–2 business days.
Estimated transit after dispatch is approximately:

Austria: 2–4 business days

Germany and other supported EU destinations: 4–10 business days
Delivery times are estimates and may be affected by circumstances outside our reasonable control.
At present, we do not offer a separate environmentally friendly delivery option. If such an option becomes available, it will be shown to you where applicable during checkout.
7. Risk during delivery
Where delivery is arranged using a shipping method offered by us, the risk of loss or damage remains with us until you, or a third party nominated by you other than the carrier, receive the goods.
8. Right of withdrawal
Consumers generally have a statutory 14-day right of withdrawal for distance purchases.
You may exercise your withdrawal right without giving a reason.
You can submit a return or cancellation request through your Whisper customer account where available, contact us by email or send us an unequivocal written statement.

The direct cost of returning goods following withdrawal is borne by the customer.
For a withdrawal from the entire order, statutory reimbursement includes the cost of our least-expensive standard outbound delivery option. Additional costs resulting from choosing a more expensive delivery option do not have to be reimbursed.
9. Statutory guarantee rights
Your statutory rights concerning faulty or non-conforming goods remain fully applicable.
Under EU consumer rules, consumers have at least a two-year legal guarantee for new consumer goods from the time the goods are received.
If goods are faulty, do not correspond to their description or otherwise do not comply with statutory conformity requirements, you may be entitled to remedies such as repair or replacement and, where the legal conditions are met, a price reduction or termination of the contract.
These statutory rights are separate from the 14-day right of withdrawal.
We do not currently offer an additional commercial durability guarantee unless expressly stated for a particular product.
10. Product information
The essential characteristics, available sizes, colours, price and other relevant information for each product are displayed on the respective product page.
Please note that screen settings and lighting may cause colours to appear slightly different from the actual product.
11. Retention of title
Goods remain our property until payment has been received in full.
12. Liability
The statutory liability rules apply.
Nothing in these Terms excludes or limits liability or consumer rights where such exclusion or limitation is not permitted by applicable law.
13. Applicable law
Austrian law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods.
For consumers, this choice of law does not deprive you of mandatory consumer protection granted by the law of the country in which you have your habitual residence where such protection applies.
14. Jurisdiction
Mandatory statutory rules concerning jurisdiction for consumers remain unaffected.
